E-Verify checks for adult entertainers?

E-Verify checks for adult entertainers?

By Jennifer Gladstone

At first it just sounds funny… in fact I’m sure you are thinking of some witty puns or one-liners right now… but there is actually a valid effort behind the idea.

stripper-backgroundcheckStrippers in Providence, Rhode Island have to get a background check before they can take it all off. City leaders want to get under aged dancers out of the clubs and crack down on prostitution.

Starting in May, all adult entertainment clubs in town started using E-Verify to make sure none of their employees are under age.  E-Verify is usually used to make sure a worker can legally work in the United States.  There is no explanation as to why this is the search they chose to use, but Club owners say they just want to be “good corporate citizens.”

Rhode Island’s Attorney General has also filed legislation that requires all owners, operators, employees and independent contractors in the state’s adult entertainment industry undergo national criminal background checks.

AG Peter Kilmartin is trying to stop alleged prostitution and human trafficking.  State Act H7518 would ban anyone whose check comes back with “disqualifying information” from working in any of these establishments.

Over the past year officials learned several of these businesses were allowing prostitution, but the real shock came when it was discovered that one club hired a 14 year old to work as a stripper.  The Attorney General says mandating national criminal records checks would not only verify the age of everyone working in a business, but it would keep management from hiring anyone who is underage since skipping a records check could cause a business to lose its license.

Adult entertainment businesses are regulated by the municipal licensing authority of their city or town. The act requires owners and operators to have their record checks complete before they can get a business license or have one renewed.  All employee criminal record checks will have to be kept of file and be available to inspection.

(As of April 1, 2014 the RI House Judiciary committee recommended the measure be held for further study.)
