As more and more states are legalizing the use of medical marijuana, one of the main questions and concerns for Employers are how new state laws are going to impact the legalities behind terminations due to a positive drug test? The use of marijuana for medicinal purposes is not protected under the ADA since the ADA is a federal law.  The Food and Drug Administration (FDA) still recognizes marijuana as a Schedule 1 Drug, therefore does not recognize the use of medical marijuana for legal use.  Even if the “drug” is endorsed by a physician an employee is a legitimate card holder, and medical marijuana is permitted under state law, the “drug” is still considered illegal under federal law. With this being said, in the states where medical marijuana is currently legal, employees are not protected from termination by the ADA.

As a last reminder, the Consumer Financial Protection Bureau (CFPB) recently modified three very important notices required by the Fair Credit Reporting Act (FCRA), and employers and consumer reporting agencies are responsible for replacing each of the existing notices with the new amended versions BEFORE the January 1, 2013 compliance date.   On November 14, 2012, the CFPB released additional modifications to these forms that corrected minor typographical and other technical errors after EBI’s initial notification to our clients and readers.  These modifications are published within the Federal Register for further review.

This past Sunday, October 21, 2012, the staff of Employment Background Investigations, Inc (EBI) joined thousands of other racers to support the Komen Maryland Race for the Cure®.  This year marks the sixth consecutive year EBI has supported this great cause as a commitment to our family, friends and co-workers that are inflicted with breast cancer.  Our encouragement and dedication is again driven from our co-worker and teammate, Heather Garner who lost her life to breast cancer just over a year ago in August of 2011.  Her fond memory is still with us as she continues to be the driving spirit alongside our team.

Senate Bill 3245 Extends the Use of E-Verify for 3 More Years

On September 18, 2012, both the House and Senate passed Senate Bill 3245 which extends the use of E-Verify until September 30, 2015.  President Obama subsequently signed the Bill on September 28, 2012.  E-Verify is an Internet-based system operated by the Department of Homeland Security in partnership with the Social Security Administration that allows participating employers to electronically verify the employment authorization of their newly hired employees.
