Pre-employment Screening:

Reduces Negligent Hiring Suits

As more and more employers are found liable for the violent acts of employees both within and outside their scope of employment, pre-employment background screening emerges as the best way to limit negligent hiring lawsuits, and to protect other employees, clients, and the workplace in general.

Every year more than 2 million Americans become victims of work-related violence, and employees in the public sector are statistically at greater risk. As a result, employers are being sued for negligent hiring more and more, and statistically they don't tend to win such cases. Losing a negligent hiring suit can cost millions, and that's without all of the bad publicity.

Many companies who are sued for negligent hiring opt to settle out of court at incredible costs. Why? Because the media loves to play upon workplace violence, making negative press as detrimental, if not more so, than the cost of the suit itself. As a result many companies would simply prefer to pay up and hope to recover costs than to lose their clientele, and their business, forever.

All of this brings the hiring process into new light. As a pivotal part of a conscientious hiring process, quality pre-employment screening can serve not only to limit violent incidences in the workplace, but to lessen the negative implications that bad PR can bring to the table. When potential employees are put through rigorous screening, employees with a history of violent behavior can be weeded out. Furthermore, when pre-employment screening has been a part of the hiring process, the employer is seen, by the public and in the eyes of the law, as having fulfilled their due diligence. This can, in turn, help an employer to maintain the trust of their clients even in the wake of workplace violence.

The only potential wrench in the works occurs when employers fall back on cheap background checks, or worse yet, public records. Both are known to produce inconsistent and even false data, and can make even the most considerate of employers appear to have been negligent in the hiring process.

This is why EBI is a leader in pre-employment screening.
