More and More the Criminal Records Check Needs to Cross Borders

Criminal cases on two different sides of the country this week both serve to support a similar premise in background screening: more and more the criminal records check must be able to cross borders in order to adequately protect clients, employees, and the workplace.

In New Jersey, the authorities have released a statement claiming that the Guatemalan janitor accused of sexually assaulting a 14-year-old student inside a classroom at The Hun School of Princeton on Jan. 18 had no business working at the elite private school. The suspect in question had been flagged by the federal government in 2005, and had a deportation order issued against him in El Paso, Texas, in June 2006. A school representative said all of Hun's full-time employees are subject to background screening and fingerprinting, but declined to comment on what level of screening the school requires for workers subcontracted through outside firms.

A similar case in California also involves the need for a criminal records check that crosses borders. Police responding to a domestic dispute in 2006 routinely consulted a national criminal database to see whether the male suspect in question had a criminal record. While he offered what looked like a valid California driver's license, his long criminal history was not uncovered in time to prevent him from murdering an innocent woman.

While both of these cases occurred on opposite sides of the country, the striking similarities in terms of background screening and the importance of the criminal records check prove that as workers come from across national borders, background screening must provide options for the proper investigation of those workers and tenants.

This has become even more important in recent years, as businesses are more often held responsible for hiring undocumented immigrants, potentially leaving themselves open to expensive fines.

But even expensive fines aren't as difficult to manage as a negligent hiring lawsuit. And as the workplace continues to evolve in a global market, the best background screening agencies will also evolve to provide the most accurate information to conscientious employers and managers.
