Pre-employment Background Screening
Fighting Workplace Violence and Negligent Hiring Suits
June 2007
As the images of the brutal fatalities at Virginia Tech, NASA, the University of Washington at Seattle and CNN demonstrate, workplace violence is a very real threat to business owners, clients, and employees. As more and more employers are found liable for violent acts of employees both within and outside their scope of employment, pre-employment background screening maintains its title as the best way to limit negligent hiring lawsuits, and to protect the workplace in general.
Every year more than 2 million Americans become victims of work-related violence, and employees in the public sector are statistically at greater risk. These incidents include assaults, robberies, thefts, hostage situations, rapes and sexual attacks.
As a result, employers are more often sued for negligent hiring, and when faced with the emotional and physical suffering of victims, even well-meaning employers do not tend to win in such cases. Losing a negligent hiring suit can cost millions, even before the bad publicity can set in.
All of this brings the hiring process into new light. As a pivotal part of a conscientious hiring process, quality pre-employment background screening can serve not only to limit violence in the workplace, or to protect the health and well-being of employees and clients, but also can work to lessen the negative implications that bad PR can bring to the table.
When comprehensive criminal records checks, drug testing, and reference checks all become part of the pre-hire process, employees with a history of violent behavior can be weeded out. Furthermore, when pre-employment background screening has been a part of the hiring process, the employer is seen, by the public and in the eyes of the law, as having fulfilled their due diligence. This can, in turn, help an employer to maintain the trust of their clients even in the wake of workplace violence.
And since none of the above is offered with a cheap, online background check, only quality employee screening can offer a safer workplace, a happier employee base, and the knowledge that managers and business owners have done their fair share in keeping dangerous individuals away from their place of work.
