Doing your Due Diligence

The non-profit group behind Internet encyclopedia giant Wikipedia learned this week that failing to do your background screening can lead to some embarrassing ramifications. At the same time what every employer should remember is that doing your due diligence offers more than PR insurance, it can prevent negligent hiring lawsuits.
Wikimedia Foundation, which runs the volunteer-written Wikipedia and its sister Web encyclopedias in other languages, neglected to do a basic background check before hiring a chief operating officer who had been convicted of theft, drunken driving and fleeing a car accident.
This revelation comes at a particularly bad time, as Wikimedia is staging a fundraising drive and trying to expand beyond a ragtag startup. By failing to do standard background screening, the non-profit organization could easily lose thousands of dollars.
But, truth be told, things could have been much worse.
Failing to do due diligence on the part of an employer or manger has led to many negligent hiring suits, and in fact, about 1/3 of all failed businesses report that negligent hiring is to blame.
Generally, due diligence refers to the care a reasonable person should take before hiring an employee, and researching the history of a potential employee is pretty standard these days in terms of fulfilling that duty.
In failing to due your due diligence as an employer or manager, the company can be held liable should an individual suffer physical, mental, or even financial harm.
Employers have been found liable for negligent hiring, or retention of dangerous or incompetent employees, in most states, including Alaska, California, Florida, Georgia, Illinois, Kansas, Maryland, New Mexico, and New York.
So while Wikipedia clearly made a mistake when they failed to conduct background screening on this employee, should important financial information or monies be lost due to such a hire, the lawsuit that could come about could equal millions of dollars lost, instead of thousands.
