The 1986 Immigration Reform and Control Act requires all U.S. employers to verify the identity and work authorization or eligibility for all individuals, whether U.S. citizens or not, hired after November 6, 1986. Employers must verify that all I-9 Forms are complete, conduct re-verification where required, have a process in place to purge I-9 Forms when employees are terminated, and have the ability to store and retrieve all completed I-9 Forms and supporting documentation for audit purposes. |

- $100 to $1,000 for each individual “paperwork” violation.
- $250 to $2,000 fine for each unauthorized individual.
- $2,000 to $5,000 for each employee if the employer has previously been in violation.
- $3,000 to $10,000 for each individual if the employer was subject to more than one cease and desist order.
- $3,000 for each unauthorized worker and criminal penalties for a pattern and practice could result in imprisonment up to six months, or both.
