why ebi > compliance

EBI is a Consumer Reporting Agency.

EBI is a Consumer Reporting Agency. As such, we exercise grave responsibilities with fairness, impartiality, and a respect for the consumer's right to privacy. You can rest assured your organization will operate in full compliance with the governing standards in our industry, including:
The FCRA is designed to protect individuals by promoting confidentiality, accuracy, relevancy, and proper utilization of information in the hands of every Consumer Reporting Agency (CRA). Most CRAs are credit bureaus that gather and provide information about individual financial history. Companies that perform pre-employment screening services, such as EBI, are also governed by the FCRA, as are the employers that use EBI's background screening services.

EBI provides our clients with all the essential notifications, letters and forms necessary to comply with FCRA employment background screening requirements, including:

  • FCRA requirements for each applicant
  • Pre-Adverse action forms
  • Adverse Action forms
  • Consumers Rights under the FCRA
  • And other FCRA compliance information and resources
  • Our obligation to compliance doesn't stop there. We assist our clients in other compliance issues such as:

    ADA Compliance
EBI operates in compliance with the Americans With Disabilities Act (ADA), which prohibits employers from discriminating against people with disabilities who are qualified to perform essential job functions.

    Safe Harbor Compliance
EBI is aware of its global responsibility to maintain the privacy of personal information. EBI complies with the requirements of the Safe Harbor Program, which prohibits the transfer of personal data to non-European Union nations that do not meet the European standard for privacy protection. California Consumer Credit Law Compliance
EBI operates in compliance with the California Consumer Credit Law (Speier Act), which restricts the reporting of age, marital status, race, color or creed on employment reports for consumers that have a current California address.

    California Legislature's AB655
For those of you who conduct background screening in California, new legislation has been enacted regarding the requirements for disclosure and consent.

    EEOC
The U.S. Equal Employment Opportunity Commission

EBI's reports allow employers to comply with the screening requirements of various government agencies, including:

  • Federal Aviation Administration (FAA)

  • Nuclear Regulatory Commission (NRC)

  • Department of Transportation (DOT)

To ensure our clients are in compliance, we post new/updated laws and regulatory information on our website. We also post any forms, notifications or letters that may be required. In addition, our clients receive notification via our EBI newsletter, the EBI Advisor.
